Part Time Work While Studying

Can I work while studying here?

The Australian minimum wage and entitlements apply to all workers, including international students, even if an international student has overstayed their visa. When working in Australia, the Fair Work Ombudsman (FWO) can assist international students in understanding their employment rights and obligations. They can also seek the FWO to resolve workplace concerns such as wages and other benefits. To enable overseas students to get the assistance they need, the FWO and the Department of Home Affairs have agreed that a student's visa will not be revoked if they:

  • Received work permit as part of their visa and believe they have been exploited at work and reported their situation to the FWO.
  • They are actively cooperating with the FWO in their inquiry.
  • It holds as long as they:
  • Reaffirm their commitment to follow their visa policies in the future, and
  • There are no additional reasons for the visa being revoked (such as on national security, character, health, or fraud grounds)
  • Under this agreement, the Department of Home Affairs will not terminate a student's visa if they seek FWO's assistance and meet the preceding criteria.

Students should adhere to the time limits set for work:
